Terms and conditions of sale

1. Purpose

These terms and conditions of sale (the "Terms") govern the sale of personalized songs and related options offered by Capturmoment (the "Seller") to any person making a purchase on the site (the "Customer").

2. Products and prices

The Seller offers the creation of a personalized song based on the information provided by the Customer. Prices are shown in US dollars, taxes included:

The Seller reserves the right to change its prices at any time; products are invoiced at the rate in effect at the time of the order.

3. Conclusion of the contract and payment

The order is placed online via the site's form and then paid through our secure payment provider Stripe. No banking details are stored by the Seller. The contract is concluded and the order confirmed once payment is confirmed.

4. Delivery

The song is delivered by email, to the address provided at the time of the order, within an indicative period of 48 to 72 hours. With the "24h Express Delivery" option, this is reduced to 24 hours. These times run from the confirmation of payment.

5. Satisfaction guarantee — 7 days

The Customer has 7 days from receipt of the song to request, by email to support@capturmoment.com, a revision or a refund if they are not satisfied.

Because the song is a custom-made work created to order, it is exempt from the standard statutory right of withdrawal for online purchases; the 7-day guarantee above is granted by the Seller on a commercial basis.

6. Revisions and refunds

The Seller commits to giving the greatest care to every creation. Within the 7 days following receipt, the Customer may request a revision of their song or, if they remain unsatisfied, a refund of their order, by email to support@capturmoment.com, stating the reason.

7. Liability and content provided

The Customer warrants that they hold the rights to the information, names and memories they submit and that this content does not infringe any third-party rights or applicable law. The Seller reserves the right to refuse any request whose content is unlawful, hateful or contrary to its values. The Seller's liability is limited to the extent permitted by applicable law.

8. Claims

Any claim may be sent to support@capturmoment.com. The Seller strives to handle every request quickly and to find an amicable solution.

9. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding conflict-of-law rules. Exclusive jurisdiction lies in Geneva (Switzerland), subject to the mandatory consumer-protection provisions that may apply to you.
